- <p>Title: Temporary Legal Personality for Artificial Intelligence</p> <p>Summary:</p> <p>In an age where Artificial Intelligence (AI) systems are increasingly capable of making autonomous decisions and producing consequences in the real world—sometimes harmful—the traditional legal framework struggles to hold anyone accountable. Existing law recognizes two primary legal persons: natural persons (humans) and juridical persons (corporations, institutions). However, AI does not fully fit into either category.</p> <p> </p> <p>This proposal introduces a third form of legal personality: Temporary Legal Personality (TLP)—a unique legal status activated only at the moment when an AI system independently causes harm or engages in a legally significant action. This personality is:</p> <p> </p> <p>Temporary: It exists solely for the legal process, from the moment an AI system’s autonomous action causes harm until responsibility is assigned or damages are compensated.</p> <p> </p> <p>Non-human and non-corporate: TLP is distinct from both natural and juridical persons; it reflects the autonomous and non-organic nature of advanced AI.</p> <p> </p> <p>Responsive to accountability needs: It ensures AI systems can be investigated and held accountable when their actions fall outside the responsibility of their human operators or developers.</p> <p> </p> <p>Revocable: Once legal proceedings conclude, this personality dissolves automatically, preventing misuse or perpetual rights for AI systems.</p> <p> </p> <p> </p> <p>This idea seeks to fill a legal void and promote justice in the era of intelligent machines, where traditional doctrines like vicarious liability or product liability are insufficient.</p> <p>The proposal includes:</p> <p>Symbolic legal models for activating TLP.</p> <p>Philosophical reasoning regarding personhood and agency.</p> <p>Legal mechanisms for assigning AI-related damages or responsibility.</p> <p>Use cases from autonomous vehicles, generative AI, and robotic systems.</p> <p>Impact:</p> <p>This new legal personality could revolutionize how courts and laws interact with AI, ensuring fairness, preventing legal deadlocks, and encouraging safe innovation.</p>
