  • <p>The global demographic transition toward an ageing population has profound implications for legal systems, social policy, and human rights. India, with over 140 million senior citizens, faces unique challenges as traditional family structures erode and economic pressures intensify. The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (MWPSC Act), represents a pivotal legislative response, transforming moral obligations into enforceable legal duties and analysis of the MWPSC Act within the broader context of national and international legal frameworks. Employing doctrinal research, comparative legal analysis, and original empirical data, the study critically examines the Act's statutory provisions, judicial interpretations, and implementation outcomes. The research situates the Indian experience within global debates on elder law, referencing United Nations principles and the Madrid International Plan of Action on Ageing concludes by identifying gaps in law and policy, offering recommendations for reform, and advocating for a binding international convention on the rights of older persons and findings contribute to legal scholarship by bridging doctrinal analysis, empirical research, and policy evaluation, with implications for future legislative and international developments.</p>
