  • <h1><strong><span>Régimen sucesorio en la Halajá: Arquitectura y ficciones legales</span></strong></h1> <p><span>This study examines the legal structure of inheritance within the Halakhic tradition, tracing its development from biblical foundations to major rabbinic codifications. The analysis considers how patrimonial transmission functions as a central mechanism for preserving family continuity and communal stability.</span></p> <p><span>By exploring the use of legal fictions and compensatory instruments within rabbinic jurisprudence, the paper highlights the tension between the prescriptive framework of the written law and the practical requirements of changing socioeconomic circumstances. Particular attention is given to the legal position of women and other heirs with limited juridical status, reassessing common historiographical assumptions regarding their role in processes of property transmission.</span></p> <p><span>The study argues that Halakhic succession law should be understood not as a fixed legal system but as an evolving interpretive tradition that balances fidelity to the textual heritage with the practical needs of family continuity and communal life.</span></p>
