•
This essay critically analyses the effectiveness of Alternative Dispute Resolution (ADR) mechanisms, specifically arbitration, mediation, and conciliation, in managing commercial disputes in India. It highlights how ADR practices, deeply embedded in India's cultural fabric, have been formalized through significant legislative action, resulting in faster, cost-effective dispute resolution. While traditional litigation often leads to strained business relationships, ADR mechanisms focus on collaborative problem solving, thereby preserving critical business relationships. Furthermore, the role of technology, particularly Online Dispute Resolution (ODR), has amplified ADR's efficacy by increasing accessibility, reducing costs, and speeding up resolution processes. However, challenges, including lack of awareness and potential cost escalations, can impede ADR's effectiveness. Despite these obstacles, ADR mechanisms, empowered by technological advances, are poised to shape the future of commercial dispute resolution in India.
