Academic Libraries Access to Information Copyrights Court Litigation Fair Use (Copyrights) Higher Education Library Acquisition Library Policy Library Services Library Surveys Mail Surveys Manuscripts Reprography Research Libraries Users (Information) Responses of 62 member libraries from the Association of Research Libraries (ARL) to a survey conducted by the Systems and Procedures Exchange Center (SPEC) about library policies and practices related to the fair use of unpublished manuscript materials indicates that recent court decisions and the current debate over fair use affect library acquisition and access to unpublished collections. Most libraries indicate that they have not stopped collecting manuscripts or making them available to users as a result of recent court cases, but some responded that they have changed their copying policies. The survey results are presented in this kit in combination with sample documents used in member libraries. Gift and deposit contracts are included from 18 member libraries. Use policies, manuscript use, and photoduplication request forms are also presented from 18 member libraries. An essay, "The Nature of the Fair Use Problem: The Statute and the Judicial Standard as They Impact Unpublished Materials," (Angie Whaley LeClercq) is presented for further reading, and a list of 14 selected readings is included.
