The necessity of this act ofconvention is analyzed, through cross-cultural examination, as a particular response ofour bureaucratic law systems to two conditions of the social order which are consideredhere as virtually universal: The existence of childhood as a relevant period in the life of thesubject, and the necessity of some kind of doctrine of responsibility to confront normativetransgressions. Cross-cultural comparison gives a perspective from which we canreflect on the specific perplexities of our own criminal law: in referring to children, thissystem applies an instrumental regime of dichotomic decisions over an ill-defined individual,whose agency has been expropriated.
