| contents |
Trademarks have traditionally been associated with words, logos, and symbols that distinguish goods and services. However, the evolving nature of commerce and branding has led to the emergence of nonconventional trademarks (NCTs) such as sound, color, scent, shape, holograms, and motion marks. These nontraditional identifiers offer unique brand recognition but also pose significant legal and procedural challenges in registration and enforcement. This paper explores the emerging trends and legal challenges related to NCTs in India and global jurisdictions. In India, the Trade Marks Act, 1999 accommodates some forms of NCTs, but the lack of explicit statutory recognition and judicial precedents creates uncertainty in their protection and enforcement. Comparatively, jurisdictions like the United States, European Union, and Australia have developed specific frameworks to recognize and regulate these trademarks, offering valuable insights for India’s evolving legal landscape.
|
