Si bien el Trienio Liberal intentó una codificación penal moderna, su aplicación fue a menudo arbitraria, reflejando aspectos de la represión absolutista que la precedió. El retorno al absolutismo reinstauró castigos duros y discrecionales, mientras que la Guerra Carlista condujo a medidas represivas específicas, incluyendo deportaciones, lo que subraya un cambio gradual hacia un enfoque liberal más codificado de la represión, aunque persistieron inconsistencias y vestigios del antiguo sistema hasta mediados del siglo XIX.</p> <p>Abstract</p> <p><span lang="EN-US">This chapter analyzes the evolution of political repression in Spain across three periods (the Absolutist Six-Year Period, the Liberal Triennium, and the era following the 1823 monarchical restoration, including the Ominous Decade and the First Carlist War), examining the legal frameworks and their actual implementation. The study reveals a persistent tension between the legal system of the Old Regime and the emergence of new political offenses linked to liberalism. While the Liberal Triennium attempted a modern penal codification, its application was often arbitrary, reflecting aspects of the absolutist repression that preceded it. The return to absolutism reinstated harsh and discretionary punishments, while the Carlist War led to specific repressive measures, including deportations, which underscores a gradual shift towards a more codified liberal approach to repression, although inconsistencies and vestiges of the old system persisted until the mid-19th century.</span></p> |
