Grounded in legal institutionalism and the law and economics approach, the research draws upon comparative legal analysis, case studies, and doctrinal methodology to assess how jurisdictions are adapting to digital finance. The paper reveals that while digital banking fosters financial innovation and inclusion, it also exposes systemic gaps in existing legal frameworks, particularly in developing economies. The study highlights best practices and policy innovations from selected jurisdictions and proposes a harmonised, forward-looking legal approach that balances innovation with robust consumer and financial protections. Ultimately, the research contributes to an informed dialogue on aligning legal regimes with technological advancement in the banking sector.</span></p> |
