Restorative justice emphasizes rehabilitation over punishment, focusing on collaborative healing processes for victims, offenders, and the community. This paper first outlines the core principles of restorative justice—such as accountability, dialogue, and community involvement—while also detailing various channels through which individuals can access restorative services, including mediation programs, restorative circles, and community service initiatives. Furthermore, it addresses existing legal provisions in India and other countries, analyzing their effectiveness and prevalence in contemporary legal frameworks. The paper delves into the rights afforded to both victims and accused individuals within the context of restorative justice, positing that the Right to Restoration holds equal significance alongside other fundamental rights. By examining the legal landscape surrounding restorative justice, this paper reveals both the obstacles and opportunities for enhanced victim and offender rights within existing statutory mechanisms. A significant component of this study is a survey conducted among participants to assess awareness levels regarding restorative justice among victims, offenders, and the general public. Findings indicate a concerning lack of understanding and accessibility, hampering the system’s efficacy and acceptance. The integration of restorative justice into the legal system offers promising implications for fostering genuine healing, promoting social reintegration, and enhancing community cohesion. This paper advocates for systemic reforms aimed at increasing awareness, improving legal provisions, and embracing restorative practices, ultimately contributing to a more humane and balanced approach to justice.</span></p> <p> </p> |
