contents <p>Abstrack<br>Domestic violence is a form of human rights violation<br>that continues to occur frequently in Indonesia, causing<br>multidimensional impacts on victims physically,<br>psychologically, and socially. The state, through Law<br>Number 23 of 2004 concerning the Elimination of<br>Domestic Violence, provides a clear legal framework for<br>the protection of victims. However, in practice, law<br>enforcement still tends to focus on punishing<br>perpetrators rather than ensuring the fulfillment of<br>victims’ rights. This situation creates a significant gap<br>between the normative ideals of legal protection and the<br>reality of its implementation in the field.<br>This study employs a normative juridical method with a<br>statutory and conceptual approach. It aims to analyze the<br>effectiveness of legal protection for victims of domestic<br>violence and to examine the fulfillment of victims’ rights<br>as regulated under Law No. 23 of 2004. The findings<br>indicate that, although the law provides various forms of<br>protection such as counseling, rehabilitation, identity<br>protection, and the right to restitution and compensation<br>its implementation remains suboptimal. The main<br>obstacles include limited institutional capacity, weak<br>coordination among law enforcement agencies, and low<br>public awareness of victims’ rights.<br>The dominance of perpetrator-oriented law enforcement<br>reflects a punitive paradigm that neglects the victim’s<br>recovery and dignity. Therefore, a shift toward a victim-<br>oriented justice system is urgently needed to achieve<br>substantive justice. The state must strengthen the<br>implementation of victim protection through pro-victim<br>policies, effective recovery mechanisms, and continuous<br>legal education to society, ensuring that victims of<br>domestic violence obtain comprehensive protection and<br>justice.</p> <p>Keywords: legal protection, domestic violence, victims’<br>rights, victim-oriented justice, Law No. 23 of 2004.</p>
