| contents | <p><strong>الملخص</strong></p> <p>يشهد العالم تحولًا رقميًا متسارعًا أعاد تشكيل بنية الحقوق والحريات الأساسية، وفرض على النظم القانونية تحديات غير مسبوقة تتعلق بحماية الخصوصية، وحرية التعبير، والأمن الرقمي، وحدود تدخل الدولة في الفضاء السيبراني.<br>يتناول هذا البحث إشكالية <strong>ميزان الحقوق والحريات الرقمية</strong> في التشريعات الشرق أوسطية، من خلال تحليل الأطر القانونية المنظمة لاستخدام التكنولوجيا الرقمية، ومدى توافقها مع المعايير الدولية لحقوق الإنسان.</p> <p>يعتمد البحث على المنهج التحليلي المقارن، مستعرضًا نماذج تشريعية مختارة، ومحللًا أوجه القصور التشريعي والتداخل بين مقتضيات الأمن القومي ومتطلبات حماية الحقوق الرقمية. كما يناقش البحث أثر التقنيات الحديثة، ولا سيما تقنيات المراقبة والذكاء الاصطناعي، على إعادة تعريف مفهوم الحرية الرقمية.</p> <p>ويخلص البحث إلى ضرورة تبني مقاربة تشريعية متوازنة تقوم على تعزيز الضمانات القانونية، وتكريس مبدأ الشرعية الرقمية، وتحقيق التوازن بين حماية الأمن العام وصون الحقوق والحريات في البيئة الرقمية.</p> <p><strong>Abstract</strong></p> <p>The rapid digital transformation has profoundly reshaped the structure of fundamental rights and freedoms, creating unprecedented legal challenges related to privacy protection, freedom of expression, digital security, and the limits of state intervention in cyberspace.<br>This paper examines the issue of <strong>balancing digital rights and freedoms</strong> within Middle Eastern legal frameworks by analyzing regulatory approaches governing digital technologies and assessing their compatibility with international human rights standards.</p> <p>Adopting an analytical and comparative methodology, the study reviews selected legislative models, highlighting legislative gaps and the tension between national security imperatives and the protection of digital rights. It further explores the impact of emerging technologies, particularly surveillance tools and artificial intelligence, on redefining the concept of digital freedom.</p> <p>The paper concludes by emphasizing the need for a balanced legislative approach that strengthens legal safeguards, reinforces the principle of digital legality, and achieves an equitable balance between public security and the protection of digital rights and freedoms in the digital environment.</p> |
