- <p><strong>RESUMEN</strong>: El margen de apreciación nacional es una doctrina que tiene su origen en el Sistema Europeo, cuyo uso por parte de los tribunales internacionales de derechos humanos se presenta cuando se advierte que no existe un acuerdo entre Estados, por lo se les concede una deferencia por razón de su soberanía para que usen el margen de apreciación nacional y resuelvan atendiendo a las particularidades propias de cada Estado involucrado. La falta de su positivización ha generado históricamente duras críticas en cuanto la utilización “no reglada” de dicha teoría; sin embargo, se considera que su alcance de aplicación ha permeado, aunque de manera incipiente, en los informes y demás resoluciones emitidas por los mecanismos que integran el Sistema Interamericano de Derechos Humanos.<br><br><strong>Palabras clave</strong>: Convenio Europeo para la Protección de los Derechos Humanos y las Libertades Fundamentales, Comisión Interamericana de Derechos Humanos, margen nacional de apreciación, Tribunal Europeo de Derechos Humanos y Tribunal de Justicia de la Unión Europea. <br><br><strong>ABSTRACT</strong>: The margin of appreciation is a doctrine originated in the European System, used by the human rights international courts when an agreement between States does not exist, conceding a deference by reason of their sovereignty to resolve taking into account the particularities of each involved State. The lack of its positivization has historically generated harsh criticism of the “non-regulated” use of this theory; however, it is considered that its scope of application has permeated, although incipiently, the reports and other resolutions issued by entities that compose the Interamerican Human Rights System.</p> <p><strong>Key words</strong>: European Convention for the Protection of Human Rights and Fundamental Freedoms, Interamerican Commission on Human Rights and Interamerican Court of Human Rights, margin of appreciation, European Court of Human Rights, European Court of Human Rights and Court of Justice of the European Union.</p>
