- While the development of the aviation industry in India has enhanced the mobility of passengers, it has also resulted in an increase in the number of disputes related to flight delays, cancellations, denied boarding, and compensation. This article explores the legal recourse available to passengers in Indian aviation through the Civil Aviation Requirements (CAR) formulated by the Directorate General of Civil Aviation (DGCA) and the Consumer Protection Act, 2019. The article explores the rights of passengers in relation to refunds, re-routing, meals, accommodation, and compensation, while also analyzing the difficulties of enforcement related to the ambiguous operational reasons provided by airlines. It also explores the effectiveness of consumer courts and grievance redressal forums like AirSewa in enhancing accountability. Through an analysis of the recent large-scale disruptions in the aviation industry, this paper identifies the gaps in the regulatory framework and makes a case for more stringent regulation and greater awareness among passengers to ensure the effective protection of consumer rights in the aviation industry in India.
